Terms and Conditions of TumpangSpace

Welcome to TumpangSpace. These Terms and Conditions outline the rules and regulations for the use of our storage and rental services.
By using our services, you are agreeing to these terms and conditions. Please read them carefully.
1. Definitions

"Customer" refers to the individual or entity using the storage or rental services.

"Services" refer to the storage and/or rental services provided by the Company.
2. Storage Agreement
2.1 Use of Storage Space
• The storage unit is intended solely for the storage of personal belongings or goods.
• Customers are prohibited from storing the following items:
o Hazardous materials (flammable, toxic, explosive, etc.).
o Perishable or food items.
o Illegal substances, firearms, or items prohibited by Malaysian law.
o Live animals or plants.
2.2 Access to Storage
• Customers may access their storage unit during the Company’s operating hours.
• The Company reserves the right to limit or deny access if the Customer violates any terms of this agreement or fails to make payments.
2.3 Storage Fees
• Storage fees are to be paid on a monthly basis, in Malaysian Ringgit (MYR).
• Payments must be made in advance, unless otherwise agreed upon.
• A late payment fee of 15 % may apply if payments are overdue by 7 days.
2.4 Termination of Storage
• Either party may terminate the storage agreement with a 30-day written notice.
• All stored items must be removed by the Customer by the termination date. Items not collected after the termination date will be considered abandoned, and the Company reserves the right to dispose of them at its discretion.
3. Rental Agreement
3.1 Rental Items
• The Company agrees to rent out equipment, tools, or other items as specified in the rental agreement.
• The Customer is responsible for returning the rented items in the same condition as they were rented, allowing for reasonable wear and tear.
3.2 Rental Fees
• Rental fees are charged on a [daily/weekly/monthly] basis, in Malaysian Ringgit (MYR).
• Late return fees may apply if the items are not returned by the agreed-upon date.
3.3 Loss or Damage
• The Customer assumes full responsibility for any loss or damage to the rented items during the rental period.
• In the event of damage or loss, the Customer agrees to compensate the Company for the cost of repair or replacement.
3.4 Termination of Rental
• The Company reserves the right to terminate the rental agreement at any time, particularly if the Customer violates any terms.
• Upon termination, all rented items must be returned immediately.
4. Payment Terms
• All payments are due upon issuance of the invoice unless otherwise stated.
• Payments can be made via cash, bank transfer, or credit card, or any other method as agreed upon.
• Non-payment or delayed payment will result in penalties, including service suspension or legal action.
5. Insurance and Liability
• The Customer is advised to purchase adequate insurance coverage for any items stored or rented.
• The Company is not liable for any loss, theft, or damage to the Customer’s property while in storage or during the rental period, unless directly caused by the Company’s negligence.
• The Company will not be responsible for any injuries or damages arising from the improper use of rented equipment.
6. Customer Obligations
• The Customer agrees to comply with all rules, regulations, and laws of Malaysia, particularly those relating to health, safety, and the use of storage and rented items.
• The Customer must not engage in illegal activities within the storage facility or misuse rented equipment.
7. Amendments
• The Company reserves the right to amend these Terms and Conditions at any time. Any updates or changes will be communicated to the Customer in writing or via email.
8. Governing Law
• These terms and conditions are governed by the laws of Malaysia, and any disputes will be subject to the jurisdiction of Malaysian courts.
9. Personal Data Protection Act (PDPA) Compliance
• The Company complies with Malaysia’s Personal Data Protection Act 2010 (PDPA). Any personal data collected from the Customer will only be used for business purposes and will not be shared with third parties without the Customer’s consent, except as required by law.
10. Force Majeure
• The Company shall not be liable for any delay or failure in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government regulations, or any other unforeseen events.
